1. The Contract
1.1

The terms of the enrolment form and these terms and conditions constitute the terms of a legally binding contract (“the Contract”) between you, the student (hereinafter referred to as “the Student”), and Limperts Academy of Design (hereinafter referred to as “LAD”). |

2. The Course
2.1 |
LAD will provide the Student with a Student Handbook. The Student Handbook contains the current rules and regulations in relation to the course and provides guidance for the Student on how to get the best results from the program. The Student must read the Student Handbook carefully before commencing the course and agrees to comply with the rules and regulations set out therein. |
2.2 |
The Student will only submit original work and will not submit work that has not been created by the Student (either written, drawn or generated by computer) without due acknowledgement of same. |
2.3 |
If the Student fails to comply with the foregoing, the Student accepts that they may be prevented from continuing the course without refund of fees, subject to the standard Appeals Procedure(s) in place with LAD. |
2.4 |
The Student accepts that if they are found to be cheating by deliberately submitting work for a project or for an examination that is not their own, by deliberately submitting work that is copied from another individual, or by deliberately submitting work that has also been used by another student, then they will be prevented from continuing the course and the award will be withheld without the option to appeal. |
2.5 |
The Student will grant to LAD in respect of any work produced by the Student during the course, a perpetual royalty-free licence to copy, use, exhibit, reproduce or publish any such work for any purposes deemed fit by LAD. |

The Student will indemnify and keep LAD indemnified against any loss or damage arising from the breach of intellectual property rights in relation to the foregoing obligations. |

LAD shall be entitled to charge the Student a handling fee on each occasion on which LAD has to mark any item of course-work more than twice. |

If the Student receives a passing grade for any course assignment or major project, the Student shall not be entitled to resubmit it for any reason, subject to the standard Appeals Procedure(s) in place with LAD. |
2.9 |
LAD reserves the right not to issue the Student with an award and/or certificate if the Student fails to achieve the required standard. |
2.10 |
LAD reserves the right without prior notice to make changes as deemed appropriate in course offerings, curricula, academic policies, and other rules and regulations affecting students and to substitute any tutor/lecturer at any time. |
2.11 |
LAD reserves the right without prior notice to change, modify or disassociate from any current accrediting agency or institution. |

LAD will not be held accountable for any errors or omissions in the course materials. |

2.13 |
The Student accepts that course material is designed to provide competent and reliable information regarding the subject matter covered and it is provided with the understanding that LAD are not engaged in rendering legal, financial or other professional advice. If legal advice or other expert assistance is required, the Student will seek the services of a competent lawyer or professional person |

The Student will indemnify and keep LAD indemnified against any liability that is incurred from the use or application of the course material or advice provided by tutors/lecturers.3. |
3. Fees and Cancellation
3.1 |
LAD reserves the right to cancel a course at any time subject to repayment of any fees received in respect of the course or the part of the course that has been cancelled. |
3.2 |
Following the acceptance of the application by LAD, the Student will be contractually bound to pay the full amount of the fees in the manner set out in the enrolment form. |
3.3 |
LAD shall charge extra tuition fees, known as extension fees, to cover rising costs if the study period exceeds the timescale detailed in the current course description, as can be found in the LAD prospectus and on the LAD website. |
3.4 |
The Student accepts they if they enrol on a progressive program of study (such as HND and Degree programs), the Student must meet the minimum grade requirements specified in order to continue their program of study. The Student accepts that failure to achieve the minimum grade requirements will prevent the Student from continuing the program of study without refund of fees paid in advance, where applicable. |
3.5 |
Where any fee or part of a fee remains unpaid 14 days after the due date, LAD reserves the right to: a) charge interest on the overdue amount at the rate of 15% per annum from the due date until actual payment; and/or b) cease supplying any course materials and tuition services to the Student without prejudice to the obligation to pay fees; and/or c) demand payment in full of all fees and instalments outstanding. |
3.6 |
LAD shall be entitled to charge the student a handling fee on each occasion that any payment that the Student submits to LAD is required to be re-presented for any reason. |
3.7 |
If the Student pays by electronic bank transfer, the Student shall ensure that LAD receives the full amount due after any bank charges that are payable. |
3.8 |
LAD shall cancel the Student’s registration with no recourse to a refund if at any time tuition fee payments fall three calendar months or more in arrears. To reactivate the registration the Student shall be required to pay a reinstatement fee to LAD in accordance with the current list of fees, over and above any instalment arrears, extension fees or any other payments that may be due. |
3.9 |
The Student understands that fees may not be transferred to another course or to another individual. |
3.10 |
Notwithstanding the aforementioned, any transfer of fees is at the sole discretion of LAD and will not be deemed by the Student to constitute a precedent. |
3. General
4.1 |
The Student will keep confidential all course materials supplied to the Student by LAD. Copyright and all other intellectual property rights in all course materials belong to LAD. |
4.2 |
All materials provided by LAD remain the property of LAD and are provided to the Student on the understanding that they may not be lent, hired, sold, copied or otherwise transferred to another individual (including other students) without prior written permission from LAD. |
4.3 |
The Student may not use LAD materials in any way except to study the course enrolled on. |
4.4 |
LAD shall not be liable for any error, omission or misstatement on LAD’s website, literature or course materials. |
4.5 |
LAD shall not be liable for any loss suffered by the student that is indirect, special or consequential or comprises loss of profits. |
4.6 |
LAD shall not be liable for any loss suffered by the Student resulting from any event that is beyond the reasonable control of LAD. |
4.7 |
If the Student requires proof of study for the purposes of insurance claims, student loan applications etc..., an administration charge of £22 shall be applied for each letter provided by LAD. |
4.8 |
The Contract contains all of the contractual terms agreed between the Student and LAD. |
4.9 |
The Student is not entitled to cancel the Contract in any circumstances other than as set out in the Contract. |
4.10 |
The Student agrees to pay any and all legal fees incurred by LAD as a result of enforcing this contract. |
4.11 |
No failure or delay by LAD in enforcing any of its rights under the Contract shall be deemed to be a waiver of such right. |
4.12 |
If any provisions of the Contract are held to be unenforceable, illegal or void in whole or in part the remaining portions of the Contract shall remain in full force and effect. |
4.13 |
This Contract shall be governed by and construed in accordance with the Laws of England if your address is in the United Kingdom or the Laws of Ireland if your address is in Ireland. The parties hereto submit to the exclusive jurisdiction of the English or Irish Courts accordingly. |
